1. Introduction
- These are the terms and conditions set out by The Learning Compass, trading as ‘www.thelearningcompass.co.uk’. Our company information is at the end of this document.
- These terms and conditions apply to all Users.
- By registering on or using our Service you enter a legally bound contract with us on the basis of these terms and conditions.
- The terms of this document are effective from Monday 1st July 2024.
- By using this service, the User agrees to these terms.
2. Definitions
- ‘Contract’ – a contract for the supply of Tuition Services between a Tutor and a Learner.
- ‘Tutor’ – a User who uses this platform to provide tuition services to Learners.
- ‘Learner’ – an individual over the age of 18 acting to find a tutor for themselves or on behalf of someone else under the age of 18.
- ‘Documents’ – all documents of whatever kind, needed for tutor vetting. (This includes but is not limited to a form of ID, personal and professional references, qualifications, proof of study, and certificates).
- ‘Service/Platform’ – our website.
- ‘User’ – a person or organisation using our Service who may or may not be registered.
- ‘Content’ – refers to all information, text, images, data and other materials provided by the Platform.
3. Service Description
- The Learning Compass provides a service that matches tutors with learners based on their educational needs, particularly focusing on neurodiverse learners and non-English speaking learners. The Platform facilitates communication and scheduling between tutors and learners.
- We reserve the right to modify or discontinue the Platform, or any part of it, with or without notice. We will not be liable to any User or any third party for any modification, suspension, or discontinuation of the Platform.
4. User Content
Users retain ownership of the content they create and share on the Platform. By submitting content, Users grant The Learning Compass a non-exclusive license to use, display, and distribute the content in connection with the Platform.
5. User Obligations and Responsibilities
5.1
Users agree to use the Platform for lawful purposes only and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use of the Platform.
5.2
Users must not submit content that is:
- Illegal
- Offensive (vulgar, racist, hateful)
- Defamatory
- Infringing on intellectual property rights
- Harmful or threatening
- Promoting self-harm
5.3
Users must not:
- Victimise or harass other people
- Send, store, display or link to upload any Content that includes someone else’s personal information unless that person is 18 years or over and you have obtained that person’s explicit written consent or you are legally allowed to do so (e.g. as a parent/guardian).
- Make recordings or screenshots of audio/video interactions without the written consent of all other participants.
- Impersonate anyone.
- Use this Service to help you compete with us or infringe our rights.
- Disrupt our Service, e.g., spam, viruses or phishing.
- Interfere with or damage our Service or gain unauthorised access to any part of the Service or equipment used to provide the Service.
- Intercept or modify communications.
- Deliberately exploit any bugs.
- Circumvent any security or other features of the Service including features that restrict the use or copying of Content.
- Attempt, encourage or assist any of the above.
5.4
Users must create an account to access certain features of the Platform.
5.5
Users must provide accurate and complete information during the registration process.
5.6
Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
6. User Accounts
- You agree that your account is for your personal use and is non-transferable.

- All intellectual property rights in the Platform and its content, including but not limited to trademarks, logos, and text, are owned by The Learning Compass.
- Users may not use the Platform’s intellectual property without prior written permission from The Learning Compass.
8. Your right to use our Service as a Tutor
8.1
You must not register on our Service if:
- You are a resident or a limited company outside of the UK;
- You are below 18 years of age;
- You have been convicted of any offence, or subject to any court order, relating to assault, violence, sexual misconduct, harassment or dishonesty.
- You do not have a valid DBS.
- You fail to provide the necessary documentation used during the vetting process.
8.2
This platform is designed for and may only be used for Tutors who genuinely intend to use their skills and our service to support and help learners with their education.
7. Right to cancel for premium paying Tutors
7.1
‘Cool off’ period
- As a premium tutor, you have the right to cancel this contract within 14 days of registering (‘cooling off period’).
- In order to cancel your contract, you must notify the team via email before the cancellation deadline at info@thelearningcompass.co.uk or via post at Learning Compass Tuition Ltd, 128 City Road, London, ECIV 2NX.
- If cancelled within the cooling-off period, the contract will end immediately.
- To meet the cancellation deadline, you must send us your communication telling us you want to cancel before the 14-day cancellation period ends
- We will refund all payments received from you no later than 14 days after the day we receive notice for cancellation.
- We will use the same means of payment used for the initial payment.
- If cancelled after the cooling-off period has ended, Users will lose access to the premium features of the platform but no refund will be given.
- No refund will be given after 14 days.
- Following the cancellation of the Contract, the package will downgrade to a basic package unless the Tutor specifically closes down their account.
7.2
Cancellation of contract
- Tutors have the right to cancel their contracts at any time.
- In order to cancel your contract, you must notify the team via email before the cancellation deadline at info@thelearningcompass.co.uk or via post at Learning Compass Tuition Ltd, 128 City Road, London, ECIV 2NX. Users will have access to the Platform until the end of the month.
8. Changes to Services
- We reserve the right to modify or discontinue the Platform, or any part of it, with or without notice.
- We will not be liable to any User or any third party for any modification, suspension, or discontinuation of the Platform.
- By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
9. Termination
9.1
We may terminate or suspend access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9.2
We are entitled to terminate this contract if:
- The terms of the Contract have been breached.
- A User is subject to repeated complaints by other Users. This will be received and a decision will be made accordingly.
- A User has not paid their fees and is refusing to pay the fees in accordance with the Contract.
- We are required to do so by law.
- A User acts inappropriately towards any member of staff.
9.3
Upon termination by the Platform, your right to use the Platform will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Payment
- Although sections of this platform are free of charge for all Users, special features are only available to Users who subscribe.
- Subscriptions can be acquired for the prices and the time periods specified on the platform.
- We reserve the right to remove or add any features applicable to subscribers at any time.
- The prices shown on the website include VAT unless stated otherwise.
- If we have mis-priced any part of our Service, we are not obliged to supply the Service provided.
- When subscribed, your subscription will auto-renew for the same price and same subscription period which you signed up, to unless stated otherwise.
- Ending your subscription does not entitle you to a refund, unless within the cooling-off period.
- You authorise us and our payment provider to charge your payment card for the relevant amounts or take payments when payments are due in accordance with these terms and conditions.
- It is your responsibility to update your payment card details as necessary.
- We reserve the right at any time to change our subscription prices. We will notify you of any changes via email one month before any changes take effect. If you do not accept the new fee, you should end your subscription by following the instructions on our Service. Otherwise the next renewal of the subscription after the one month’s notice will be at the new price.
- If a payment fails, we reserve the right to downgrade your account to a basic membership until the payment is successful. All use of special features will be lost in this scenario.
- After 1 payment fail, we will attempt to take the payment again.
11. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the United Kingdom without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of the UK.
12. Disclaimers and Limitation of Liability
12.1
Service “As Is”
The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Platform will be error-free or uninterrupted.
12.2
Limitation of Liability
To the fullest extent permitted by law, The Learning Compass will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Platform
- Any unauthorised access to or use of our servers and/or any personal information stored therein
13. Dispute Resolution
- In the event of a dispute, Users agree to first attempt to resolve the issue informally by contacting The Learning Compass.
- If the dispute is not resolved within 30 days, it may be resolved through mediation or arbitration, as mutually agreed upon by the parties.
14. Privacy Policy
Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.
You agree that we may process your personal information in accordance with the terms of our privacy and cookies policy which may change from time to time.
15. Insurance Policy
- If you are a Tutor, you agree that in connection with the supply of the Tuition services provided by parents, you have the reasonably appropriate insurance supplied by our insurance partner at a discounted rate that is available to premium tutors.
- All basic and premium package tutors are responsible for having insurance to protect yourself.
- The insurance services displayed on our Platform are used at Tutors’ own risk. We are not legally responsible for those sites or services.
16. Guidance
- We do not guarantee that guidance or other general information provided by this Platform is correct as this will depend on the time and place that you access it. We do not accept legal responsibility for it.
- Before acting on the information, you must do your own research and make your own appropriate and careful enquiries including the accuracy, suitability and appropriateness of the services for your purposes.
- The guidance is not tailored to your specific circumstances or as a substitution for a certain qualification or level of training. You rely on this information at your own risk.
17. Functioning
- We do not guarantee that the platform will be uninterrupted or error-free. We are entitled, without notice and without liability to suspend the Service for repair, maintenance, improvement or other technical reasons or to make changes.
18. Translation
- The translation from English into other languages is done via Google. Therefore, we do not take responsibility for minor changes in the meaning of the translation.
- We do not take responsibility if the translation is not entirely accurate.

- We take complaints very seriously and will strive to ensure a positive outcome is achieved and all parties are satisfied.
